Clarification Regarding General Plan Draft Environmental Impact Report
The environmental document analyzing environmental impacts on the proposed draft General Plan 2035, called a Draft Environmental Impact Report (or “DEIR”), was released for public comment on August 8, 2022. The statutory comment period is 45 days, which will expire at 5:00 p.m. on September 22, 2022. This deadline, as stated in the required Notice of Availability, has been prominently displayed on the City’s website in multiple locations for more than 3 weeks. Please note that this 45-day public comment period on the DEIR—which expires at 5:00 p.m. on September 22, 2022—does not “close” public comment on the actual draft General Plan 2035 document. The public comment period on the draft General Plan 2035 document remains open until the General Plan 2035 is approved by the City Council.
Recently, staff inadvertently misstated the DEIR comment period deadline as “September 24, 2022,” in a written staff report and presentation for the August 31, 2022, special joint meeting of the City Council and Planning Commission. This special joint meeting was scheduled as a study session on proposed changes in land use density in the General Plan 2035. Despite the staff error in describing the applicable date for expiration of the 45-day statutory period, the actual date and time for receiving comments on the DEIR remains as 5:00 p.m. on September 22, 2022, as stated on the City’s website and as identified in the official Notice of Availability. We apologize for any confusion the inadvertent error may have caused.
